LaROCQUE J. Ronald Rumpel, a discharged bank officer, appeals a partial summary judgment dismissing his defamation claim against his former employer, Bank of Buffalo, and its liability carrier, American States Insurance Company. Rumpel, an employee at will, argues that the bank impliedly accused him of wrongdoing when the bank discharged him after having openly investigated him. We conclude that the bank was conditionally privileged to investigate Rumpel as an employee of the bank, and that Rumpel failed to meet his burden to show an abuse of the privilege. We therefore affirm the judgment of the circuit court.
